Terms of Usage
1. Force of the Terms
1.1 These terms apply between a person (from here on “the Customer”) and Autotarvete OÜ (“the Seller”).The Seller is the owner of an online shopping site www.saabianti.ee/webshop (“the Online Shop”).
1.2 In addition to the terms presented here, the legal relations created from buying products from the Online Shop are also regulated by the effective laws of Estonian Republic.
2. Products
2.1 The prices shown on the Online Shop’s website are in euros. The prices already include a sales tax of 20%.
2.2 The prices and availability of the products may change without notice.
2.3 The photos shown on the website are illustrative and may differ from real products. The difference depends on the settings of the screen. The differences are minimal and not all photos differ from real products.
3. Payment
3.1 Making payments is possible through bank links, credit cards and debit cards.
4. Delivery
4.1 Delivery within Tallinn is free of postal charges.
4.2 The delivery takes 1–10 working days. The delivery time depends on the size and weight of the product and the transportation firm chosen.
Products can also be received during working hours on the same day from our Tallinn warehouse in Telliskivi 51B, 10611. For more information about the availability and delivery of products please make an inquiry HERE.
4.3 The products are delivered to the Customer through SmartPost or Post24 automated packaging systems, with a carrier or a registered letter. The delivery method depends on the size of the product.
4.4 Before placing an order the Customer has to make sure that the product fits with their car. If needed the Customer can contact our staff pood[ät]saabianti.ee BEFORE placing the order to prevent misunderstandings, useless transportation and crediting money.
The Seller is not responsible for misunderstandings if the Customer had not made sure whether the product fits with their car.
4.5 The Customer has to make sure that the contact info given by them is correct. This is to prevent delay and misunderstandings about the delivery.
The Seller is not responsible for the delay and misunderstandings caused by incorrect contact info given by the Customer.
4.6 The Customer becomes the owner of the product after paying for it.
5. Returns and Refunds
5.1 The Customer can withdraw from the contract within 14 days after receiving the product according to the terms below.
5.2 By buying the Customer agrees that they can return the product only under the following terms:
5.2.1 The product returned does not fit with the car, because the product information on the Online Shop’s website was incorrect.
5.2.2 The code on the package or the invoice does not suit the content of the package (in other words, a wrong product has been packaged).
5.2.3 The product has a manufacturing defect.
5.2.4 The product must be unused and in its original package (the Customer has to open the original package carefully without damaging it. The product does not have to be in its original package if opening the package was impossible.).
5.2.5 To return a product please fill in a form of withdrawal HERE. The form should be sent to pood[ät]saabianti.ee in order to agree on further actions.
If contacted beforehand, the products can be returned to our office in Telliskivi 51B, 10611, Tallinn. Products can also be returned through SmartPost or Post24 services.
5.2.6 The money will be refunded to the Customer’s bank account within 14 days starting from when the Seller received the returned product.
Within Estonia the postal charges of returning a product will be paid by the Seller.
5.2.7 The Online Shop will not reclaim products that have been damaged by the Customer or during transportation.
5.2.8 The Online Shop will not reclaim products if the Customer had not made sure whether the product fits with their car.
5.2.9 Products/spare parts that have been discounted are not eligible for return.
6. Warranty
6.1 A warranty of 1 year is applied to the products sold by the Online Shop.
6.2 The warranty does not apply to products that are damaged by using wrong installation methods or too much force and to products that do not have a manufacturing defect.
6.3 The warranty does not apply to products that have been damaged during transportation.[Claims for damaged or broken shipments must be addressed directly to the company that made the delivery. The seller is not obliged to process complaints related to the shipment.]
6.4 The warranty does not apply to products that have worn out naturally.
7. Liability and Force Majeure
7.1 The Seller and the Customer are responsible for harming each other’s rights by violating the terms presented. The extent of their responsibility is regulated by the effective laws in Estonia.
7.2 The Seller is not responsible for the damage brought on to the Customer if the Seller could not have prevented the damage, did not and could not foresee the damage coming (force majeure).
8. Processing Personal Data
8.1 By entering contact info on the Online Shop’s website the Consumer gives the Online Shop a right to collect, process and forward their data to the Online Shop’s partner of logistics. Such personal data includes the Consumer’s name, their contact phone number, home address and/or delivery address and e-mail address.
8.2 The Online Shop has the right to use the Customer’s address for sending adverts and other information.
8.3 The Customer has a right at any time to forbid the Online Shop from collecting and using their personal data, unless the data is needed to deliver the products or to collect a claim that has come up from the contract.
8.4 Electronic personal data for direct mailing will only be used if the Customer gives their permission for it.
8.5 If the Customer makes the payment through a bank with encrypted data communication the Customer assures the safety of their own personal bank acceptance. The Online Shop does not have access to these bank acceptance data.
9. The Course of Filing Complaints
9.1 The Online Shop is responsible for the product sold being defective if the defect appears within one year starting from delivery.
9.2 If a defect appears the Customer has the right to contact the Online Shop, delivering the invoice against what the payment was made.
9.3 The Customer must quit using the product immediately after a defect appears.
9.4 The Online Shop and the Customer agree on fixing or replacing the defective product.
Fixing the product by the manufacturer will be compensated by the Online Shop.
9.5 The Online Shop is not responsible for defects created by storing or using the product in a wrong way.
9.6 If a product is defective we kindly ask you to send a complaint letter to our e-mail address pood@saabianti.ee. In the letter please note the name of the Customer, the number of the order and a specific description of the defect.
9.7 The complaint must be sent within one month after detecting the defect.
9.8 All complaints will be looked through and the Customer will be contacted as soon as possible but not later than 14 days after receiving the complaint.
9.9 The Customer can ask the Online Shop to lower the price. The Customer can terminate the contract and ask for a refund if
the Online Shop cannot fix or replace the product,
or fixing or replacing the product fails,
or the Online Shop has not fixed the product within reasonable time,
or unreasonable inconvenience has been caused to the Customer.
10. Other Terms and Conditions
10.1 If the Online Shop rejects the complaint or the Customer is not satisfied with the solution and thinks their rights have been violated, the Customer can file a complaint to the court or to the Consumer Disputes Committee through the Consumer Protection Board.
The Customer can file the complaint by themself or by a representative.
